Emily Dowdy gets off the Oklahoma railroad

A week after their daughter Emily Dowdy was released from an Oklahoma prison and sent to a treatment facility, Nancy and Charlie Jackson say they are still in a "state of disbelief."

Convicted of vehicular manslaughter after a 1999 car accident that killed Ryan Brewer, the 20-year-old son of an Oklahoma City police officer, Dowdy, a former architecture student at the University of Oklahoma, was sentenced to 40 years in the penitentiary. The prosecution contended Dowdy was drunk; her defense attorneys argued that she was drugged by GHB, a date rape drug.

Her sentence was cut to 26 years on appeal, but after hearing arguments from prosecutors and defense attorney Frank Courbois, Judge Kenneth Watson suspended the remainder of that sentence and ordered her to spend the next two years at a drug and alcohol treatment facility.

Dowdy, 33, who attended the hearing in shackles, was transferred hours later to The Carter Center in Oklahoma City. Nancy Jackson says her progress will be evaluated after 90 days, and Dowdy could be given work release as early as October. "We hope the judge will send her to Texas," Jackson says.

Ryan Brewer's father, David, who is now in charge of the OKC police department's fatality investigation squad, told reporters he was disappointed with the judge's decision. Calling the reduction "a slap on the wrist," Brewer said the reduced sentence "only encourages it to happen more."

Judge Watson, however, made a point in the hearing of saying Dowdy's punishment was unusually harsh and that many others convicted of the same crime in Oklahoma had been given much shorter sentences.

Originally from Hillsboro, Dowdy was featured in a Dallas Observer story headlined "Oklahoma Railroad" (July 21, 2005), about her treatment at the hands of the Oklahoma justice system. The story revealed prosecutorial misconduct and showed that Judge Susan Caswell, a policeman's wife and the presiding judge at Dowdy's trial, was making rulings biased in favor of the District Attorney's Office.

Caswell was defeated in the last election by criminal defense attorney Watson, who had sat in on some of the testimony in Dowdy's third and last trial.

Last week, the Jacksons hoped their daughter might get some combination of sentence reduction and probation but were unprepared for the ruling that meant she would get out of prison immediately.

"I was in shock when the judge said he was suspending the rest of her sentence," says Nancy. Since the Jacksons have always contended that their daughter was not an alcoholic, they foresee no problems for her at the rehab center.

"Just imagine, three short days ago, Emily lived behind a 16-foot-tall razor-wire fence, and today she is dressed in street clothes, free as a bird, no fence, no prison grays, no prison ID," Nancy wrote to supporters.

    I would just like to say that this case is unreal, emily is a really good person, i wish that i would have gotten to really know her years ago, she is one of the most caring,person that i have ever meet, not to mention one of the strongest,( can u put our self in her shoes?) think about all the things that she has had to go thru! she and her family has been thru hell. the thing that really gets to me is the fact that the system here in oklahoma is not at its best, they are sending people to prison for crimes that they didnt comit, or may i say had no control over. The system is the one that is really in the wrong here!! they know it , yet they are not doing anything about it.

    I don't see how it's anyone's business what happened to any money given to Emily's family for legal defense, except those who donated to it. I doubt any of the naysayers commenting did, therefore it's not anyone's business. Luckily for everyone Mrs. Jackson shared the info. Everyone needs to get over it. Emily Dowdy was treated harshly because she was a pretty blonde female, everyone assumed she was drunk. Because it was a cop's kid she was made out to be horrible. Justice has now been carried out, so everyone should just move on. Case closed, you know? Best wishes to the your family, Mrs. Jackson, and I hope your daughter is able to live a good life when she gets out.

    Thank you stewie and the other comments about Emily Dowdy being released from jail way to soon. I can for a fact tell you that Ryan Brewer's family is not happy with the decision handed down. But Ryan's death and the case and our side have never received fairness from Glenda Whitley for as long as the trial went on so we don't expect fairness from her now. I wish too I knew the connection..Because why did Emily get so much press? She a drunk driver who killed some body ..Some body important to us but why so much written on her. Almost everything everything report about the case by her was untrue. She never asked us any questions about the case or about Ryan...Talk about a railroading...You all in Texas got railroaded by Glenda on this one. Almost everything she wrote was untrue and was spoon fed to her by Nancy Jackson. Are they friends or is it more..Is she a special reporter(Glenda) that gets to write lies and half truths and not get called on it? Is there a special reason why the only one she spoke to about this case or that she reported comments from was Mrs Jackson. I can tell you it is because that was the only person she talked to..Talk about using your job and the newspaper you work for a personal agenda. This was a case from out of state. I feel sorry for those of you living in the same state, same town with her. If she can generate this much rag time on an out of state case like ours She must steamroll all over y'all at will if she does not agree with you. How does the biggest state in the union and the biggest city around allow such baise views and untruthful reporting.Well Glenda I have question for you...Emily set up a defense fund and fundraising website to help her pay her lawyers fees is that all it was used for?     I don't understand why everyone seems to think this woman was mistreated by the crimminal justice system. She was driving inntoxicated and killed a innocent young man who was just on his way home after spending a quiet evening with his girlfriend. His only crime was having the misfortune of being on the same road as a drunk. If you go on the internet and look at the summary of Emily Dowdy's case you will see Judge Caswell ruled in her favor about as much as sher ruled for the proscution. Emily's orginal bail was set at only 1500.00, Judge Caswell allowed Emily to leave the state to attend a football game, and move out of state while awaiting trial to live with her boyfriend. Emily admitted under oath to drinking alachol while out on bond which was a violation of her bond, but Judge Caswell did not revoke her bond. Seems she got pretty fair treatment. Also check out the court of crimminal appeals. Four judges reviewed Emily's appeal and ruled on it reducing her sentence from 40 years to 25. Everyone seems to think she was treated unfairly becausr Ryan Brewer was a policeman's son. You are overlooking the fact that Emily Dowdy was convicted and sentanced twice by two seperate juries, not the Judge or DA. Bottom line is Emily Dowdy chose to drink and drive and a young man paid for it with his life. Emily served about four and one half years. Ryan Brewer has no more years. His family is serving a lifetime of grief. I think she got off cheap. She got away with murder.

    I wisht that Glenna would let us in on her connection to this the drunk blonde murderer so we can put it in perspective. I wonder how the parents of this young man feel about the sentance that he was given. Perhaps they think death is just too harsh of a sentance for someone who didn't do anything.     I don't understand the outrage people are showing because this girl FINALLY got a fair sentence. She was given a ridiculously long sentence to begin with, yes it was harsh. Especially for a first time offense. Whether she was drunk or drugged against her will, the sentence was still harsh. And in light of the facts, the pictures that showed with wrong captions, and it was a cop's kid, she was given shoddy justice. But now thanks to a change in the courts, Emily's going to be allowed to get on with her mistake. For a first time offense, rehab, and the amount of time she's spent in jail, is more than enough. Especially since she's going to have to live with the fact she killed someone for the rest of her life.

    Glenna Wow, this drunk ass chick/murderer just got some reverse SWIFT BOATING by you. So I assume if you fight for your country in Viet Nam, one is pretty much the scum of the earth. If you drink, drive, kill, and have blonde hair..your a SWIFT BOATING HERO. Now can you please explain the the parents of this lost child why we should feel victory in this decision?     Why does this woman deserve so much coverage? She killed someone while driving intoxicated, then comes up with an excuse that, conveniently, can't be disproved and she's treated to an article making her out to be a totally innocent political prisoner. Then her release from prison is celebrated like Nelson Mandela's. I'd like to see how well the "I was date-rape drugged but can't prove it" excuse goes for someone who isn't a pretty blonde white girl.
