Local swingers think life is a bowl of cherries, but Duncanville wants to spit out the Pit

Horses roam aimlessly in a meadow just around the block. There's a Boy Scout camp about a half-mile away.The green thicket behind the plain, ranch-style house prevents exposure to adjoining homeowners, one of whom waveswarmly at passing motorists as he mows his lawn. In this Duncanville neighborhood, there exists a rural serenity—or at least there used to, before Jim Trulock's home became notorious in North Texas and across America.His house, also known as The Cherry Pit, has grabbed headlines because of what has for years transpired behind its closed doors.

"We're swingers," says Trulock, smiling. "But we're not criminals."

Trulock, 59, and his sweetheart Julie Norris, 30, are avid participants in what swingers refer to as "the lifestyle," and are overseers of this controversial party house where men are urged to make "donations" to defray expenses, women are admitted free, and anything-goes debauchery is the raison d'être. For more than a decade before the police raids and the bad publicity, The Cherry Pit would draw 50 to 100 people each weekend; in the last year alone, it has played host to as many as 7,000 guests.

Trulock contends his slice of this mushrooming subculture is merely a family hangout where First Amendment rights are exercised in the form of saucy games such as "Naked Twister."

"We don't push it on anybody. We don't recruit. We teach people who want to learn," Trulock says. "We're an honest, loving, extended family."

The City of Duncanville, however, is not feeling the love. It sees The Cherry Pit as an illegal and immoral business gobbling up unreported income and sullying the neighborhood. City fathers couldn't have been pleased that The Cherry Pit maintains a Web site that encourages others to come to Duncanville to join the fun: "We are a group of like-minded friends who enjoy living the swinging lifestyle. We party on weekends and enjoy meeting new friends."

In September 2007, acting on a traffic-related complaint from a neighbor, the Duncanville police visited the house but did not arrest Trulock. Instead the city posted "No Parking'' signs in front of his home. On November 6, 2007, the Duncanville City Council enacted an ordinance making it illegal to operate a "sex club" in a residential area. A month later, Trulock received the first of five citations, each alleging three distinct charges: operating an illegal sex club, operating a sexually oriented business without a license and operating a business in a residentially zoned area. All 15 offenses were low-grade Class C misdemeanors, punishable only by fines.

Trulock's lawyers, Ed Klein and Garry Cantrell, wasted no time in attacking the constitutionality of Duncanville's new sex club ordinance, filing a civil rights case in state court alleging that the new law infringed on the free association rights of their client. "These are people who get together because they want to be with each other," Klein says. "It's not a business, there is no president or stockholders—it doesn't even have registered members."

In May 2008, the city of Duncanville again voiced its disgust with The Cherry Pit. It amended its sex club ordinance, says Klein, in what appeared to be an attempt to cure its constitutional shortcomings.

And things were just beginning to heat up.

Two Duncanville police raids, on July 19 and July 22, led to one arrest as well as the at-gunpoint confiscation of a variety of items inside the house. Based on an informant's tip, police executed search warrants, seizing thousands of dollars in "Fun Money'' (vouchers used like arcade tokens), $815 in real money, volumes of porn and "Cherry Pit business cards.'' (If it has business cards, isn't it a business?) Authorities also seized partygoers' cell phones, one man's Viagra pills and a bag of donation forms. (If the forms say "donation," isn't that what's being solicited?)

During the July 19 search, the Duncanville police allegedly found an assortment of tools of the sex trade: A stripper pole. A bondage room. Unclean mattresses on the floor. Porn. A dance floor. Panties hanging from the ceiling. A hot tub with an unsavory broth.

Police returned the second time to seize alcohol they had found the first time but failed to specify in their earlier warrant—582 bottles of liquor. In the first raid, Norris claims, she received a bruise to her forehead when she attempted to answer the door as the police broke it down with a battering ram.

"We tried to play nice,'' says Duncanville City Manager Kent Cagle, noting that over the last few years, Trulock was visited by the police chief, the fire chief and a city building official. "They spoke to him, [but] he came back with a new, even more defiant attitude.''

Cagle is leading the charge against The Cherry Pit and rattles off his city's well-publicized list of potential allegations against Trulock: Organized criminal activity, prostitution, narcotics trafficking, money laundering. He mentions that a home with a septic system is not equipped to handle a houseful of 100 people and that guests "walk around drunk'' in the front yard.

"It's 95 percent a legal issue,'' he maintains. "If your neighbor was raising pigs in a slaughterhouse next door, or running an auto-repair shop with junkers in the yard next door, they would be in violation. That's what's happening here, and when they claim they are not a business, they are not being honest.''

    What we are dealing with here is not a question of taste or tact but simply a violation of these peoples rights to have sex with other in the privacy of their own home. You may not agree with their actions and thats your right but what we have here is a witch hunt because the town officials don't agree with their actions. I support his right to engauge in acts within the privacy of his own home. Without diversity, our culture will decay. Political perspectives from the left and right must both be expressed, if we really want voters to make rational decisions. This is not popular thought among the polarized people who think there is only one way to think. Fortunately, where I live anyway, I am free to question those who won't tolerate any perspective but their own. So good luck to theswingers in Tx

    What a waste of people's tax money and time...Who cares what a bunch of people do in the privacy of their own home? They are trying to make examples, but they are being ignorant of the fact that swinging goes on in EVERY major city, and closing down a small house-party does nothing but draw attention to the matter (even bad publicity is good publicity) and waste a bunch of money... Shame on you City of Duncanville...grow up. Not everyone eats from the same dish.

    What do you think would happen if all other 'swingers' events would appear in the media just as the Cherry Pits have? Are they such a close group of people that they would petition for their rights? This is just the one of many in the DFW and surrounding areas. Not to mention, has anyone been into a dance club lately and observe the behavior and fornication that goes on in there as well!?!?!? I think Dunanville is hard up for revenue and to scared to go after real criminals, which are plenty in the city!

    Cities all over North Texas happily allow consenting unmarried adults, even those happily committing adultery, to pay, to rent a Hotel or motel room, to have their "immoral" sex. But if this should go on on someone's private property.... then it just becomes "too" immoral for North Texas cities.... Start banning unmarried adult couples from sharing the same hotel and motel rooms.... (which they would NEVER do....)and this special harrasment of the Cherry Pit would start to make sense. Duncanville will sleep better knowing all the group fornication will now only be done at "respected" hotels and motels.... What a farce ! And airs of respectibility !!!

    I am a former regular of the Cherry Pit and the city never gave any trouble till lately makes you wonder what stirred up their hives! I would still go but now live out of state and all the charges are bullshit! Hope someone uncovers the skeltons in the city's closet soon!

    This controversy should be about operating a business in a residential neighborhood, not whether consenting adults want to engage in the lifestyle. The Cherry Pit is a business and whether the owner admits it or not he is profiting from the donations in one way or another. Holding parties of this magnitude every weekend infringes on the rights of the neighbors, 50 to 100 couples showing up on weekends, with all those cars parked in the neighborhood, who would not be annoyed if that was happening in their neighborhood. There are plenty of empty buildings for rent in the metroplex that are more than 1000 feet from a neighborhood, church or school. Take it somewhere else. Lastly, shame on Mr Trulock for bringing such a negative light to the lifestyle and shame on Mr Cagle for trying to assert his moral values on the people he serves. That�s what ministers are for.

    Mike Fisher, you made yourself look stupid. I can get business cards at Kinko's for $5.00. That doesn't make me a business. The city of Duncanville is acting ridiculous. Government cannot and should not legislate morality. And the people shouldn't stand for it, lest the government starts saying something you do in your private life is "immoral."

    While Dan and I are big proponents of protecting our freedoms and living the life we choose to live in the privacy of our own homes, I can't help but feel that this is not an issue about swingers, but an issue about running a club in a residential neighborhood. It may have started out all in good fun, but when it gets this big, it's time to find a better venue. I have no issue with my neighbors throwing a swinger party, even every weekend, but 100 people? Stop and think about that for a minute... That's somewhere between 25 and 50 cars (minimum) lining the street in your neighborhood. Regardless of the City of Duncanville's moral and ethical arguments, this is just too much traffic for a residential area. Trying to make this into an issue about "Swinging" is missing the point. My suggestion is to limit your house parties to 20 people or less!

Jealousy can occur, but Proponents of swinging assert that jealousy is mainly couples whose relationships were already unstable.     I feel bad for the Cherry Pit owners because they are fighting a uphill battle. They didn't have everything in order. It's evident that the City Of Duncanville is using everything they can to harrass them. At some point the City needs to allow the legal system to take its course and not pursue some of the petty charges. With that being said, there are plenty of wealthy Dallas people who engage in these types of activities for years. This is a bright light on a their little secret. Personally I don't have a problem with people living out their sexual fantasy with consenting adults. No matter what their job is.

    I�ve seen the self-serving the claim by proponents of �the lifestyle� that American combat pilots �serviced� each other�s wives to keep them �faithful� during World War II and find it doubtful as well as abhorrent. Human beings are not animals bound by the universal impulse to life but people created in the image of God with minds, souls and the moral good sense to sublimiate their sexual impulse in order to create families, children, homes and civilizations. Public display of the perverse and destructive �lifestyle� shouldn�t be tolerated in a civilized culture whether in Duncanville or any other city anywhere in the country. If the owners of the "Cherry Pit" had kept themselves below the radar no one would know or care what debauchery occured in their �home� but since they advertise their �parties� on the internet, it becomes the business of the community to either condone or condemn. Kudos to the City of Duncanville for standing against this moral outrage. And the city manager is correct: it� just plain nasty.
